Red Rock Shine Windows Photo Protection
Terms of Service
Effective date:
These terms govern the Red Rock Shine Windows Photo Protection utility, operated by Red Rock Shine in St. George, Utah, United States. They do not govern vehicle-detailing appointments, website customer accounts or maintenance-wash payment agreements.
1. Acceptance and eligibility
You must be at least 18 years old and legally able to agree to these terms. By installing, configuring or using Windows Photo Protection, you agree to these terms. If you act for an organization, you must have authority to do so. If you do not agree, do not install or use the utility.
Reading this page alone does not activate backups or authorize access to Google Drive or either source gallery. Those actions require the separate approvals and Google authorization requested during setup.
2. What the app does
Windows Photo Protection is an owner-operated utility for copying original photos from the approved live and development Red Rock Shine galleries into new private folders in the owner's Google Drive account. It creates backup manifests and checks copied bytes against file sizes and SHA-256 checksums. Daily checks can be enabled after the owner approves scheduled private Drive writes and live-gallery reads.
The utility is not a complete website, customer-account, booking-database or computer backup service. It does not continuously capture every change between checks, automatically restore a website, overwrite original gallery files, publish the website or guarantee that every lost photo can be recovered.
4. Your operational responsibilities
Use only one approved durable Windows computer and one Windows user profile for the daily runner. Preserve its private journal and lock across restarts. Do not run a second host, duplicate or reset the journal, clear an unresolved lock, or bypass a failed-check gate to force another write.
Keep the computer powered on, awake, online and signed into the scheduled Windows account. The approved source websites must also be reachable. Provide sufficient private Drive storage and local disk space, and keep the computer and software secure.
Check the reported verification time and status. A completed, verified snapshot covers the photos observed at that check, not later uploads. Incomplete folders and a scheduled task that merely exists are not proof of a successful backup. Ambiguous writes, missing journals, damaged copies or lost disks require review before retrying.
A change of host or Windows user requires a reviewed migration and reconciliation, not a new parallel installation. Recovery and restore-test actions require their own owner approval and separate targets; never overwrite originals as part of a drill.
5. Acceptable use
Use the utility lawfully and only for approved photo protection. Do not use it to copy material without permission, infringe another person's rights, distribute unlawful content, commit fraud, interfere with a source website or Google, or obtain unauthorized access.
Do not evade consent, privacy, verification, locking or retry safeguards; misrepresent a failed backup as verified; or use the app for unrelated scraping or surveillance. Do not reverse engineer the software to defeat its security controls, except where applicable law expressly permits the activity. Respect Google's API and account policies.
6. Content and software rights
You and the relevant rights holders retain ownership of your original photos and other content. You authorize the limited copying, storage and read-back necessary for the photo protection you approve. These terms do not transfer ownership of your photos to Red Rock Shine or permit their sale, advertising use or AI training.
Red Rock Shine and its licensors retain their rights in the utility, branding and documentation. You receive a limited, non-exclusive permission to use the utility for its stated purpose while following these terms. Third-party and open-source components remain subject to their own applicable licenses, which these terms do not override.
7. Privacy and Google services
The Privacy Policy explains the data used, limited Drive scope, private destinations, Windows credential protection, retention and revocation controls. The Windows utility uses Google Drive and the Red Rock Shine source websites; no additional data services are used by the utility.
Google is an independent service provider, not a party to these terms or a sponsor of Red Rock Shine. Google's terms, privacy policy, account limits and storage rules apply separately. Google or the source websites may become unavailable, restrict access or change their APIs; Red Rock Shine cannot control those decisions.
8. Fees and third-party costs
Red Rock Shine does not charge a fee to use Windows Photo Protection. The utility does not enroll you in a paid plan or initiate recurring charges. These terms do not authorize any vehicle-detailing charge.
You are responsible for any Google Drive storage subscription, internet access, computer or other third-party costs you choose to incur. Those providers set their own billing, cancellation and refund rules. Keeping every completed and incomplete copy can increase your storage use. Any future paid offering would require separate notice and your agreement; these terms do not authorize future billing.
9. Retention, stopping and termination
Completed backups, incomplete copies and separately created restore-test copies are retained until you delete them yourself. The utility does not automatically delete copies or impose a retention expiry. You control your Google Drive files and should review recovery needs before deleting them.
You may stop using the utility by disabling “Red Rock Shine Daily Photo Protection” in Windows Task Scheduler and revoking its Google access. Confirm that no check is running before removing local credentials or app files. Stopping, uninstalling or revoking access does not erase Drive copies. Preserve the private journal while protection is active and reconcile its history before any future restart after journal loss.
Red Rock Shine may withdraw permission to use the utility or discontinue support for a material violation, legal requirement or security concern. This does not remotely delete private copies, revoke your own Google account or disable a task on your computer. You remain responsible for stopping the local task and managing retained files. Provisions concerning ownership, retained data, liability and disputes continue as needed after use ends.
10. Availability and warranty limits
The utility is provided “as is” and “as available,” to the extent permitted by applicable law. Red Rock Shine does not promise continuous operation, a service-level agreement, error-free software, a fixed recovery time or protection against every outage, account compromise, hardware failure or data loss.
To the extent permitted by law, Red Rock Shine disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. Keep other appropriate recovery arrangements and verify important backups. Nothing in these terms excludes a warranty, remedy or consumer protection that the law does not allow to be excluded.
11. Limits of liability
To the extent permitted by applicable law, Red Rock Shine is not liable for indirect, incidental, special or consequential damages, including lost profits, business interruption or loss of data arising from use of the utility or third-party services.
To the extent permitted by law, Red Rock Shine's total liability for claims arising from the utility is limited to the greater of US $100 or the fees you paid Red Rock Shine specifically for this utility during the 12 months before the event giving rise to the claim. The utility is currently free.
These limits do not apply to fraud, willful misconduct, gross negligence, or any liability or remedy that applicable law prohibits limiting. They do not remove your non-waivable statutory rights.
12. Changes to the utility and terms
Red Rock Shine may update the utility and these terms. Revised terms will be posted here with an updated effective date. For material changes, Red Rock Shine will provide at least 15 days' notice before applying them to continued use, unless a shorter period is necessary to address a legal or urgent security requirement.
Changes are not retroactive. If you do not accept revised terms, stop using the utility before they take effect. Updating these terms does not grant broader Google permissions or approve new sharing, deletion, fees, hosts or production actions. Those changes require any applicable separate authorization.
13. Governing law and disputes
Utah law governs these terms, without regard to conflict-of-law rules, except where mandatory applicable law requires otherwise. Where legally permitted, disputes concerning the utility may be brought in the state or federal courts serving Washington County, Utah.
These terms do not impose mandatory arbitration, waive a jury trial or class action, or prevent you from using a court or remedy that mandatory law makes available to you. If a provision is unenforceable, it will apply only to the lawful extent and the remaining provisions will continue in effect.
